Introduction

For subclass 101 visa which is a permanent child visa the applicant who is under 18 years of age must be outside of Australia at the time of application and be sponsored by their parent or parent’s partner. If the child is 18 years or over 18 years old, must be single, full-time student who is financially dependent on the sponsoring parent, or the child is unable to work due to a disability.

Eligibility Requirements

Before you apply for a visa you must make sure you meet the following requirements:

  • In some cases, if you have had a visa cancelled or application for a visa refused, you might not be eligible to apply for this visa but in some circumstance, you still can apply
  • for partner visa.
  • The applicant must be outside Australia when the application is lodged
  • The applicant must have a sponsor to apply for this visa
  • The sponsor must be Australian permanent resident or Australian citizen or Eligible New Zealand Citizen
  • The sponsor must be approved by Department
  • And sponsor must meet all other relevant requirements such as;
  • Age requirement (Be 18 years old).
  • The applicant and sponsor must meet character requirements
  • The applicant must meet the health requirements
  • The applicant must not have debt to the Australian government.

Partner (Migrant) visa (subclasses 309 and 100 Offshore)


Introduction

The Partner Visa (Subclass 309 provisional and 100 permanent) is a two-stage application, for applicants who are located outside Australia. This visa is often referred to as a Marriage Visa, De Facto Visa or Spouse Visa. Regardless of its name, applicants are applying for two connected visas simultaneously. In most cases, the Subclass 309 (provisional visa) will be granted first with two years waiting period imposed on the grant of the Subclass 100 (permanent) Visa.

Partner Visa (Subclasses 820 and 801 Onshore)
