Child Visa

Australia has ranges child visas depending on the circumstances of the child. Dependent children, adopted children or orphan children of Australian citizens, permanent residents or eligible New Zealand citizens can benefit from the visa options available to them, to join their parents in Australia.

Children are usually granted visa when their parents are granted visa but sometime the children may need to apply for visa independently as in the case of adoption. Which visa the child or children can apply for depends on their individual circumstances such as age, dependency status, and the location of the children.

Types of Child Visa

There are three types of Child Visas:

Subclass 101 Child Visa

For subclass 101 visa which is a permanent child visa the applicant who is under 18 years of age must be outside of Australia at the time of application and be sponsored by their parent or parent’s partner. If the child is 18 years or over 18 years old, must be single, full-time student who is financially dependent on the sponsoring parent, or the child is unable to work due to a disability.

Subclass 802 Child Visa

This is a permanent visa as a holder of this visa the child can work, study and access the Medicare. To be eligible to apply for this visa, the child must be under 18 years of age, or over 18 but unable to work due to mental or physical disability. Additionally, the child must be single and financially dependent on the parent. The child must be in Australia during the lodgement of the application.

Subclass 837 Orphan relative

For orphan relative (permanent) visa the applicant must meet the following criteria:

  • The child must be in Australia at the time of application
  • The relative of the child such as such as a brother, sister, grandparent, aunt, uncle, niece, nephew, or step-equivalent, must be the sponsor.
  • Be unable to be cared for by their parents due to the parents being missing, deceased, or permanently incapacitated.
  • Be under 18 years of age when applying for the visa.
